Online casino Stake has lost its brief legal reprieve in Brazil after a federal appeals court overturned an injunction that let the betting platform operate until October 25, despite the government’s nationwide gambling ban. With legal challenges mounting and the sector’s future remaining unclear, operators with Brazilian licenses are scrambling to defend their investments. Stake Had No Time to Enjoy Its Win On Friday, October 9, the Federal Regional Court of the 3rd Region granted the federal government’s request to suspend a previous day’s decision by São Paulo’s 9th Federal Civil Court. This newest ruling removes the temporary protection that had kept authorities from revoking Stake’s license and blocking its platform. The suspension will remain active until the original case concludes or the court issues another decision. The Attorney General’s office, which challenged the injunction, argued that the ruling gave Stake an unfair market advantage. This stance swayed the appeals court. It agreed that allowing the company to remain active could cause regulatory inequality, lead to inconsistent application of government policy, and encourage other gambling operators to pursue similar legal avenues. Notably, the appeals court did not examine the merits of Stake’s lawsuit or the constitutionality of the government’s provisional measure. The decision to revoke the injunction focused on the consequences of allowing a single operator to remain in business while competitors were banned from the market. Unfortunately for the operator, it is now in the same boat as the rest of the sector. Brazil’s Gambling Ban Remains in Place for Now This dispute began after President Lula’s September provisional measure banned all forms of fixed-odds gambling. Companies were forced to shut down their services, as the prohibition even affected local operators that had been active in Brazil for years. Stake challenged this measure in court, aiming to preserve its business and keep its federal gambling license. However, its efforts were in vain. Brazil’s legal gambling market remains in limbo as it is yet unclear whether the provisional measure will remain in place. The Attorney General’s office recently asked Supreme Federal Tribunal Justice Luiz Fux to reject all legal challenges to the ban and deny operators’ compensation requests. Meanwhile, betting companies, sports clubs and broadcasters are set to suffer significant losses. The ongoing elections could prove critical as some believe that Flávio Bolsonaro, Lula’s top rival, could restore the nation’s regulated gambling industry. Brazil’s Congress is also scheduled to review the provisional measure, though the legislative timetable means the case may remain unresolved until 2027. For Stake, a return to the market now relies on factors outside its direct control.
